Terms of Service

These Terms of Service (“Terms”) govern your access to and use of DropForge (“DropForge,” “we,” “us”), a batch video editor for TikTok Shop and Instagram Shop creators operated by Apex Intelligence. By creating an account, starting a trial, or using the service, you agree to these Terms. If you don’t agree, don’t use DropForge.
1. What DropForge does
DropForge lets you upload product videos you own, automatically generates short text captions (“hooks”) tuned to sales psychology, and burns those hooks onto your videos as on-screen overlays. All video processing happens in your browser via FFmpeg.wasm — your video files never leave your device. We also let you attach metadata for commercial-safe trending sounds; the actual sound is attached inside TikTok when you upload.
2. AI-generated content
Some features of DropForge are powered by AI models (currently Anthropic’s Claude family). Specifically:
- We analyze a handful of frames from your first uploaded video to guess the product category, brand, benefit, and target customer. These are suggestions you can accept or edit.
- We generate short text hooks (1–2 sentences) tuned to your product and funnel stage. You can accept, edit, or regenerate any hook.
DropForge does not generate video imagery, synthetic voices, or deepfake content. Every video in your batch is footage you uploaded yourself — we only add a text caption and your product name watermark. The AI output is the caption text, not the video.
You are responsible for ensuring the text captions you publish are accurate and non-deceptive. If you use DropForge to produce content that could be considered AI-generated under applicable platform rules or law (for example, if you overlay AI text onto synthetic footage from another tool), you must disclose that consistent with those rules.
3. Your content, your responsibility
You retain full ownership of every video you upload and every edit you make. You grant DropForge a limited, non-exclusive license to process your content solely for the purpose of providing the service (previewing videos, extracting frames for auto-detect, rendering overlays, generating exports). We do not claim any right to your content beyond that, and we do not retain copies of your video files on our servers.
You represent and warrant that:
- You own or have the right to use every video you upload to DropForge.
- Your content does not violate any third-party rights (copyright, trademark, right of publicity, etc.).
- Your content does not contain illegal, infringing, harassing, or platform-prohibited material.
4. TikTok and third-party platform compliance
DropForge is a creator productivity tool. When you export videos from DropForge and upload them to TikTok, Instagram, or any other platform, you remain subject to that platform’s own terms of service and community guidelines. Specifically:
- TikTok Community Guidelines:you must follow TikTok’s rules on content, including the prohibitions on misleading claims, counterfeit products, harassment, and spam. DropForge does not automate uploads or post on your behalf.
- TikTok Branded Content / Shop policies:if you’re selling a product via TikTok Shop, comply with TikTok’s seller policies, including accurate product representation and Shop-tag usage rules.
- Sound attribution: the sound picker shows commercial-safe sound metadata as a reference. You attach the actual sound inside the TikTok app at upload time. You are responsible for ensuring any sound you use is licensed for your intended commercial use.
5. Prohibited uses
You may not use DropForge to:
- Produce or distribute deceptive, fraudulent, or misleading content, including false product claims or fake testimonials.
- Create content that impersonates another person or entity, including unauthorized use of AI-generated likenesses.
- Upload content you don’t own or have permission to use.
- Automate spam, mass-post across accounts, or otherwise violate the terms of any platform where you publish.
- Generate hooks for illegal products, regulated goods in jurisdictions where such promotion is restricted, or content targeted at minors for restricted categories.
- Scrape, reverse-engineer, or attempt to extract the underlying models, prompts, or system architecture of DropForge.
6. Accounts and trials
You must be at least 13 years old to use DropForge. If you’re under 18, you may only use the service with the consent of a parent or guardian.
New accounts get a 7-day trial with full feature access. At the end of the trial, you’ll be prompted to pick a paid plan. No payment method is required during the trial and you can cancel at any time. After the trial, continued access requires an active subscription.
You are responsible for keeping your login credentials secure and for all activity under your account.
7. Subscription and billing
Paid subscriptions are processed by Stripe. Your payment method is charged monthly or annually based on the plan you select. Plans auto-renew unless you cancel. You can cancel at any time from the billing portal; your access continues through the end of the billing period, then stops.
Trial conversions, refunds, and proration follow standard industry practice: we don’t refund partial months, but we’ll work with you on good-faith disputes over double-charges or service failures.
Prices and plan features may change; you’ll get at least 30 days’ notice before a price increase that affects you.
8. Intellectual property
DropForge, the logo, the UI, the software, the psychology framework that drives hook generation, and the underlying prompt engineering are the intellectual property of Apex Intelligence. You’re granted a non-exclusive, non-transferable license to use the service during the term of your subscription — no ownership transfer.
Generated hook text you accept into a batch is yours to use commercially. You may not claim that DropForge endorses a particular product or that hooks came from a source other than AI-assisted copywriting.
9. Third-party services
DropForge uses third-party infrastructure, each of whom may process some portion of your data under their own privacy terms. As of the date above, these include Supabase (database + auth), Anthropic (AI model provider), Stripe (payments), Vercel (hosting), Resend (email delivery), and PostHog (product analytics). 10. Service availability and modifications
We operate DropForge on a commercially reasonable uptime basis. We don’t promise zero downtime and we may modify, suspend, or discontinue features at any time. For material changes to core paid functionality, we’ll give reasonable notice.
11. Termination
You can cancel your subscription or delete your account at any time. We can suspend or terminate your account for material violations of these Terms, extended non-payment, or activity that creates legal or security risk for us or other users. Where practical, we’ll give you notice and a chance to cure first.
12. Disclaimers
DropForge is provided “as is.” We don’t promise that AI-generated hooks will convert, that your videos will go viral, or that you’ll make sales. We don’t guarantee compatibility with every browser, every video codec, every device, or every network condition. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, Apex Intelligence’s total liability for any claim arising out of or related to DropForge is limited to the greater of (a) the amount you paid to us in the 12 months prior to the event giving rise to the claim, or (b) $100. We are not liable for indirect, incidental, consequential, special, or punitive damages — including lost profits, lost sales, lost content, or reputational harm — even if advised of the possibility of such damages.
14. Indemnification
You agree to defend and indemnify Apex Intelligence against any third-party claim arising out of (a) your content, (b) your use of DropForge in violation of these Terms, (c) your infringement of any third party’s rights, or (d) your violation of any applicable law or platform rule.
15. Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Gwinnett County, Georgia, and you consent to personal jurisdiction there.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll notify you by email and/or by posting a notice inside the app before the changes take effect. Your continued use of DropForge after the effective date constitutes acceptance.
